Two days ago, I posted a satirical story that detailed Bernard Berrian’s Twitter exchange with Minnesota state representative John Kriesel, a double-amputee veteran of the Iraq war. It didn’t make fun of Berrian; it was more critical of the way some media outlets blew the exchange out of proportion. I would link to it, except we’ve removed the post due to the threat of legal action.How did our First Amendment right to free speech and satire get quashed? Well, that’s easy: we don’t have the sort of legal funds that can handle a frivolous lawsuit, so we pulled the post instead of standing up for our constitutional rights and getting sued for the trouble.
Here’s how it went down: before getting the cease-and-desist from from Berrian’s legal team, we received an email from Lindsey Deierling, VP of Publicity at EAG Sports (twitter page here). I won’t reprint her email here for legal reasons, but there was a lot of talk of “defamatory” and “damaging to his public image” and “negative perception” and a misunderstanding of the word “slander.” (Note to Lindsey: slander is spoken; libel is written.)Pretty sad that he was threatened to be sued for satire. Classy move there, berrian, real classy.Sadly, the response I received was from Lindsey the PR drone, and not Lindsey the human. Her email reply to the above maintained the demands of the original email, and flat-out ignored my offer to raise money for charity, help Berrian’s image, or address the unlikelihood of golden retriever puppies criticizing Berrian’s woeful on-field performance. She also didn’t offer me anything resembling congratulations on my engagement. Who does that?I’m not going to say anything negative about Berrian here. I just find it baffling that a starting wide receiver in the NFL would knowledgeably move forward with frivolous legal action against an Iraq veteran just days after telling a vet in a wheelchair to sit down and shut up. We could have had a laugh and raised some money for whichever charity he wanted. Instead, I’m going to hate Bernard Berrian forever.

Given the way he's played I would think it would be really hard to damage his reputation and create anymore of a negative perception of him than already exists. The Bears made him a fair offer and Minny matched that with a ridiculous one. Didn't exactly get their monies worth did they but they still seem to like ex Bears WR's. Now how intelligent is that?
I'm getting to that age where a lifetime warranty just doesn't mean as much to me anymore as an afternoon nap.

True on both counts and I'm sure by now the Vikes wish that hadn't done it. It's has to be a bitch to lose a guy like Sidney Rice in favor of keeping BB but what's with those guys and our former WR's. Marcus Robinson, Bobby Wade, BB, and now DA? The only one who was never productive with us is DA.

EDEN PRAIRIE, Minn. -- Bernard Berrian remains a part of the Minnesota Vikings' offensive plans.
One day after Berrian was a healthy scratch for the first time in his NFL career, Vikings coach Leslie Frazier said Monday the wide receiver will be back in the rotation this week for playing time.
"I don't foresee any future problems," Frazier said. "I really expect him to play at a high level for us and play well."
Berrian was on the inactive list for Sunday's 34-10 victory over the Arizona Cardinals for a disciplinary reason that Frazier declined to specify. The St. Paul Pioneer Press, citing an unidentified person with knowledge of the situation, reported that Berrian was punished for missing two team meetings the day before the game, but Frazier wouldn't confirm that Monday.
"He understands what we have to get done and what's required of him, like all of our guys do," Frazier said. "Going forward, we've just got to do the right things."
Frazier said he believes Berrian's mind is in the right place and that he's still counting on the receiver to contribute.
"He wants to help this football team win," Frazier said. "We're going to give him every opportunity to help this football team win."
Berrian was Minnesota's big free-agent addition when he signed for $16 million guaranteed in 2008, and he played up to his billing that year with eight touchdowns, including one punt return for a score, and 964 receiving yards. His average of 20-plus yards per catch led the NFL.
